Legal Aspects of CBD:

  • The Hemp Farming Act of 2018 (December) – was signed into law by President Trump legalizing hemp (as long as it contains 0.3% THC or less) at the federal level. The Act defines hemp as Cannabis with 0.3% THC or less dry weight including all parts of the plant and removes it from the Controlled Substances Act allowing states to regulate commercial hemp farming after submitting a plan for regulation to the USDA. CDB Oil is a derivative of the hemp plant, therefore making it legal under federal law as long as it has less than 0.3% THC.

  • State of Texas Position – Texas State House Bill 1325, OFFICIALLY SIGNED/PASSED – June 10, 2019 – Gov Greg Abbott. Section 443.201: Retail Sales of Consumable Hemp Products > A person may possess, transport, sell, or purchase a consumable hemp product (cannabidiol) processed or manufactured in compliance with this Chapter. These products must contain less the 0.3% of THC (the psychoactive element found in the plant).
